Short answer
Heirs have 180 working days from the death to file the inheritance tax return (declaración sucesoral) with SENIAT, about eight to nine months. It is filed online on the SENIAT portal and the documents are then lodged at the office. Filing late costs a fine of 100 times the official exchange rate of the highest-value currency, and without the clearance certificate SENIAT issues no registry can record the sale of the inherited property.

The deadline: 180 working days
Article 27 of the Inheritance Tax Law gives 180 days from the opening of the estate, which is the date of death. Since the law does not say they are consecutive days, the Organic Tax Code counts them as working days. On the calendar that is about eight to nine months.
If the inventory of assets is complicated or there is an insurmountable obstacle, article 33 allows you to ask SENIAT for an extraordinary extension. It has to be requested before the 180 days run out, in writing and with the reasons.
- Day 0
Death
The estate opens and the article 27 deadline starts running from this date.
- Before day 180
Extension, if needed
Only if the inventory is complicated or there is an insurmountable obstacle. It is requested in writing with the reasons, and has to be filed before the deadline runs out.
- Working day 180
The filing deadline
About eight to nine months on the calendar. From here on the return is late.
- 5 working days later
Lodge the originals
The printed copies and the payment forms are handed in at the SENIAT office within five working days of filing online.
The law does not say how long the extension lasts, and the sources that give a number do not agree with each other. Do not count on it when planning the sale.
The documents
To register the estate’s RIF
- The original death certificate and a copy.
- The deceased’s ID card.
- Each heir’s ID card and RIF, and the birth certificates of any minors.
- A signed proof of residence.
To lodge the return
- Two copies of the return, printed on both sides, and the payment forms with the bank’s certification.
- The estate’s current RIF.
- The deceased’s marriage, divorce or civil partnership certificate, and the death certificates of any heirs who died before them.
- Title documents for each asset: properties, vehicles, accounts and shares.
- Invoices or documents proving the debts being deducted.
- The will, if there is one, and the lawyer’s power of attorney if the lawyer is filing.
Step by step on the SENIAT portal
- Register the estate’s RIF on the portal and lodge the RIF documents.
- Log in to SENIAT online with the estate’s username and password.
- Go to the taxpayer menu, then tax processes, then inheritance.
- Check the details of the deceased and the heirs, choose the type of inheritance (by will, without a will, or with benefit of inventory) and record the extension if you were granted one.
- Enter properties, movable assets, debts, allowances such as the main home, and exemptions.
- In the summary, assign each heir’s share. The system calculates the tax.
- File, print two copies of the return and the payment forms, and pay. If you file on time you can pay in up to four instalments.
- Lodge the originals at the SENIAT office within the next five working days.
These steps follow SENIAT’s instructions and press guides from 2025 and 2026. The menu names on the portal may vary.
How much is paid
The tax is calculated on each heir’s net share, in tax units, at a progressive rate that depends on the relationship. For parents, children and spouse:
| Each heir’s share | Rate |
|---|---|
| Up to 15 T.U. | 1% |
| 15.01 to 50 T.U. | 2.5% |
| 50.01 to 100 T.U. | 5% |
| 100.01 to 250 T.U. | 7.5% |
| 250.01 to 500 T.U. | 10% |
| 500.01 to 1,000 T.U. | 15% |
| 1,000.01 to 4,000 T.U. | 20% |
| Over 4,000 T.U. | 25% |
- The tax unit (unidad tributaria) has been worth 43 bolívares since 2 June 2025.
- A share of 75 T.U. or less received by a parent, a child or the spouse is exempt (article 8).
- The deceased’s main home is left out of the taxable base when it passes to parents, children or spouse (article 10). On the portal it is entered as an allowance.
With the tax unit at 43 bolívares, the top band starts at 172,000 bolívares. That is why the main home exclusion is what weighs most in an estate with an apartment in Caracas.
Fines for filing late
| Situation | Fine |
|---|---|
| Filing late, within the year after the deadline | 100 times the official exchange rate of the highest-value currency |
| Not filing, or filing more than a year late | 150 times that exchange rate |
- Late-payment interest is added.
- You lose the option of paying in instalments.
- The inherited assets are bound to the payment of the tax and the fines (article 50).
- Without the clearance certificate, no sale of any inherited property can be registered (article 51).
If an heir lives abroad
Every heir needs a current RIF to register the estate. Someone living abroad can act through a special power of attorney granted at a Venezuelan consulate or before a local notary with an apostille. It is worth making the power cover both stages: the SENIAT procedure and the sale at the registry. How to word it is in the guide to the special power of attorney.
The clearance certificate and the sale
When the tax is paid, or the inheritance turns out to be exempt, SENIAT issues the clearance certificate (certificado de solvencia, article 45). Article 51 forbids registrars, judges and notaries from recording any sale of an inherited asset without that certificate.
With the certificate in hand, the rest of the sale follows: update the cadastral certificate to the estate’s name, ask for the municipal tax clearance and book the registry appointment. The full order is in the guide to selling.
Frequently asked questions

What is the fine for not filing the inheritance tax return on time?
100 times the official exchange rate of the highest-value currency if you file within the year after the deadline, and 150 times if you do not file or file later, plus late-payment interest.
