Short answer
The law sets no list of requirements for the tenant: what is asked for comes from market practice. In Caracas you are usually asked for an ID card or passport, a RIF, an employment or income letter, personal references and, depending on the case, a guarantor. What the law does set since August 2026 is the limit on the deposit: an insurance policy or a deposit of up to three months’ rent, never both.

What they usually ask for
- A current ID card (cédula) or passport.
- A RIF, especially if a company is signing the contract.
- An employment letter, payslips or proof of income.
- Personal references and, sometimes, from the previous landlord.
- A guarantor who owns property, when the owner requires one.
None of these requirements is in the rental law: they are market custom. An owner can ask for more, less or nothing, and you can ask why each document is needed before handing it over.
What the law does guarantee you
If you sign on or after 7 August 2026, your contract falls under that year’s special regime. What it brings you:
- The deposit is capped: an insurance policy or a deposit of up to three months’ rent (article 16).
- The deposit is returned within fifteen calendar days of handing the property back, less proven repairs and unpaid services (article 18).
- The rent does not go up during the term of the contract (article 13).
- The contract must be in writing and state the term, the rent, the services and who pays the utilities (article 8).
- The property must meet minimum habitability conditions, and cannot be rented in areas declared high-risk (article 10).
- After two years or more in the property and up to date with payments, you have a right of first refusal if the owner decides to sell (article 20).
The other side of it: eviction no longer goes through the prior SUNAVI procedure, but straight to the municipal court, and the law does not mention the statutory extension. It is explained in the guide to the 2026 law.

How much you need on signing day
Work out the first month’s rent plus the deposit. With the three-month cap, the initial outlay on a 300-dollar rental goes from 600 dollars, if the deposit is one month, to 1,200 if it is three.
If someone asks you for six months or a year in advance, ask why: the 2026 law caps the deposit at three months’ rent for contracts under its regime.
What to check before signing
- Check that whoever signs is the owner or has power to do so, and that this capacity is written into the contract.
- Ask for the contract to state the term, the rent, the currency, and how the bolívar equivalent is paid if the rent is in foreign currency.
- Walk through the property and record in writing, with photos, the state you receive it in. That is what later avoids deductions from the deposit.
- Ask about the backup generator, water, gas and condominium: what there is, what fails and who pays for each.
- Check what happens if you need to leave before the term ends and how much notice you must give, because the law sets no such period.
Frequently asked questions
Is a guarantor compulsory to rent in Caracas?
Not by law. The guarantor is market custom and the owner decides whether to require one. Since August 2026 the contract’s guarantee is a single one, an insurance policy or a deposit of up to three months, so it is worth asking whether the guarantor replaces it or is added to it.
Can they raise my rent mid-contract?
For contracts signed from 7 August 2026, no: the rent stays the same for the whole term. Any adjustment is discussed on renewal and needs both parties to agree.
When do I get my deposit back?
Within fifteen calendar days of handing the property back, after the inspection and less proven repairs and unpaid services.
Can I rent as a foreigner?
In practice you are asked for a current identity document and proof of income, like any tenant. Confirm with the owner which documents they accept before reserving the property.
