The rental contract in Venezuela: what it must say in 2026

Short answer

Under the August 2026 law the contract must be in writing and contain at least six things: who the parties are and in what capacity they act, which property it is, the term, the amount of the rent, the list of services and who pays the utilities. Taking it to a notary is optional and it does not need registering: a private signature binds just the same from the day it is signed.

The minimum content the law requires

Article 8 of the 2026 rental law requires the contract to be in writing and to contain, at a minimum:

  • The name and identification of the parties and the capacity in which they act, that is whether they sign as owners, as attorneys or on behalf of an estate.
  • Identification of the property.
  • The agreed term.
  • The amount of the rent.
  • The list of services that come with the property.
  • Who has to pay the utilities.

If you sign on someone else’s behalf, that capacity is proven with a power of attorney. When the owner lives abroad, the power is granted at the consulate or apostilled: it is explained in the guide to the special power of attorney.

What the law leaves open and the contract must say

These are the gaps the lawyers who have analysed the law point out. None resolves itself: if the contract is silent, it is left to interpretation.

PointWhat the law saysWhat is worth writing
Notice of not renewingSets no periodA specific number of days and how notice is given
Adjusting rent in foreign currencyOnly caps rents in bolívares, at the CPIWhen and how the rent is reviewed on renewal
Payment in bolívaresAllows the equivalent at the BCV rate, read in different waysWhich rate, which day and with what proof
State of the propertyRequires an inspection on returnAn inventory with photos signed by both parties at move-in
RepairsSplits at 30% of the monthly rent (art. 15)Who calls the technician and how quickly they respond

Deposit, services and costs

The guarantee is a single one: an insurance policy or a deposit of up to three months’ rent (article 16). The deposit is returned within fifteen calendar days of the handover, less proven repairs and unpaid services (article 18).

Unless agreed otherwise, the tenant pays the utilities and the owner pays the condominium fee and the property tax (article 19). It is worth writing it down even though the law already says so, because it is the most common dispute at the end of a contract.

In Caracas the contract should also name the backup generator, the water well or tank and the piped gas: who maintains them, who pays for the fuel and what happens when they fail.

Property for rent

The notary: optional, and when it is worth it

Article 9 allows the contract to be authenticated before any notary, without prejudice to the parties signing it privately. Both forms bind from signing. Authenticating costs money and time, and in exchange it records the date and the signatures before a third party, which helps if the contract ends up in court.

Article 21 accepts digital notices between the parties when it can be proven they were sent and received. If you are going to use WhatsApp or email to give notice of anything, say so in the contract with each party’s address or number.

Mistakes that cost dearly

  • Copying a template from before August 2026: it carries over SUNAVI, the statutory extension and rents in bolívares that no longer fit the new regime.
  • Asking for a deposit and a guarantor at once without checking: the law sets one guarantee and a three-month cap.
  • Leaving no inventory or photos of the initial state, which is what later allows deductions from the deposit.
  • Forgetting the notice period, and finding at expiry that the contract continued automatically on the same terms.
  • Not identifying the capacity in which someone who is not the owner signs.

Frequently asked questions

Is a rental contract signed only between the parties valid?

Yes. Article 9 makes the notary optional and a private signature binds from the day it is signed. What the law does require is that the contract be in writing and contain the minimum in article 8.

Can the rent be set in dollars in the contract?

Yes, article 14 allows it. The tenant can pay the equivalent in bolívares at the Central Bank’s rate on the day of payment, so it is worth writing down which rate is used and how payment is proven.

How much deposit can I ask for?

Up to three months’ rent, as an alternative to an insurance policy, not in addition to it. It is returned within fifteen calendar days of the property being handed back.

Does the contract have to be registered with any body?

The 2026 law sets up no register for contracts under its regime. Check with your lawyer whether any obligation from the earlier rules remains in your case.

5 dated sources

This guide is general information, not legal advice. Venezuelan rules change often, and the special 2026 rental regime only covers contracts signed from 7 August that year: check every step with a lawyer before you act.
